Promotion Terms and Conditions
TERMS AND CONDITIONS FOR PROMOTIONAL CAMPAIGNS AT EVELINE ONLINE STORE
1. General provisions and definitions
1.1. These Terms and Conditions set out the rules for organizing and participating in promotional campaigns (hereinafter: the “Promotions”) carried out in the online store available at evelinecosmetics.com
(hereinafter: the “Store”).
1.2. The organizer of the promotional campaigns is the operator of the Eveline Cosmetics e-store: Beauty Brands Ecommerce sp. z o. o., with its registered office at ul. Żytnia 19, 05-506 Lesznowola, entered into the Register of Entrepreneurs of the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under KRS number 0000760609, REGON: 381956358, NIP: 1231417982 (hereinafter: the “Seller”).
1.3. The terms used in these Terms and Conditions shall mean:
a) Customer/Participant – an entity placing an order in the Store;
b) Product – goods available in the Store;
c) Cart – the Store module used to compile an order;
d) Discount Code – a code enabling a specific Promotion;
e) Promotion Information – a description of the Promotion provided by the Seller in the Store, in particular on the Promotion page, in banners, in the discount code description, in the Cart or at the order placement stage, including e.g. the duration, rules, product scope, any exclusions and limits.
1.4. These Terms and Conditions are the only document describing the general rules of the Promotions. The details of a specific Promotion result from the Promotion Information presented in the Store (not as separate terms and conditions, but as a message/description in the Store).
2. Place and duration of the Promotions
2.1. Promotions apply exclusively in the Store, unless the Promotion Information states otherwise.
2.2. Promotions may apply for a fixed period, until the promotional stock/pool is exhausted, or until cancelled — in accordance with the Promotion Information.
2.3. The Seller may change or end a Promotion during its duration; however, changes do not affect orders placed and paid for before the changes take effect (unless applicable laws provide otherwise).
3. Rules of participation in Promotions
3.1. Participation in Promotions is voluntary.
3.2. Using a Promotion means acceptance of these Terms and Conditions and acknowledgement of the Promotion Information displayed in the Store (including in the Cart).
3.3. Promotions may be applied automatically (e.g., after meeting conditions in the Cart) or after entering a Discount Code — depending on the specific Promotion.
4. Combining Promotions and discounted products
4.1. As a general rule in the Store, Promotions can be combined with each other and can be combined with Discount Codes, unless the Promotion Information clearly states otherwise (e.g., “This Promotion cannot be combined with other promotions/codes”).
4.2. As a general rule in the Store, Promotions also apply to discounted products, unless the Promotion Information indicates an exclusion (e.g., “-30% only on non-discounted products” or “This Promotion does not apply to discounts/sale items”).
4.3. If the conditions of several Promotions are met at the same time, the Store system applies them in accordance with the Store’s technical mechanisms and the Promotion logic (e.g., product discount, cart discount, product for €1). The final price is visible in the Cart before placing the order.
5. Types of Promotions and mechanisms
The Seller may apply, in particular, the following mechanisms:
5.1. Bundle promotions:
a) 1+1 – when purchasing 2 Products covered by the Promotion, the cheaper Product in the pair is discounted (e.g., to €1 or by the indicated discount — in accordance with the Promotion Information).
b) Second -50% – when purchasing 2 Products covered by the Promotion, the cheaper Product in the pair receives a discount (e.g., 50% — in accordance with the Promotion Information).
d) 3+1 – when purchasing 4 Products covered by the Promotion, the cheapest Product among the four is discounted in accordance with the Promotion Information.
5.1.2. Bundle promotions may be applied multiple times within one order (e.g., 2/4/6 items), unless the Promotion Information provides limits.
5.2. Percentage discount on selected products/categories (product discount)
5.2.1. The Promotion consists of reducing the price of selected Products or Products from a specified category/series by a given percentage (e.g., “-15% on all makeup products”, “-20% on selected products”).
5.2.2. The product discount may be applied automatically or after entering a Discount Code — in accordance with the Promotion Information.
5.2.3. The scope of Products covered by the product discount (e.g., the entire category, selected SKUs, selected series) and any exclusions (e.g., “not applicable to new arrivals” / “not applicable to sets”) result from the Promotion Information displayed in the Store.
5.3. Percentage discount on the cart/order
The Promotion consists of reducing the order value by a specified percentage (e.g., -10%, -20%, -30%) applied automatically or after entering a Discount Code — in accordance with the Promotion Information (including possible exclusions, e.g., “only on non-discounted items”).
5.4. Fixed-amount discount on the cart/order
The Promotion consists of reducing the order value by a specified amount (e.g., -€20, -€50), applied automatically or after entering a Discount Code — in accordance with the Promotion Information.
6. “Product for €1” Promotions — two mechanisms
6.1. Mechanism A: “Product for €1 after reaching a threshold” — Customer selection in the Cart
6.1.1. The Promotion consists of the possibility to purchase a Product/Products for €1 after meeting the condition indicated in the Promotion Information (e.g., reaching a minimum order value threshold).
6.1.2. The Promotion is carried out in the Cart — after meeting the condition, the Customer can independently select a Product from the list available in the Cart (or indicated in the Cart), and then the Customer adds it to the Cart. The price of the selected Product is set to €1.
6.1.3. If the Customer does not select and add a Product in the Cart, the Promotion will not be applied.
6.1.4. Availability of the €1 Product depends on stock levels. If the selected Product is unavailable, the Customer may choose another available Product, provided it is available on the list.
6.2. Mechanism B: “Product for €1 with a Discount Code” — automatic addition
6.2.1. The Promotion consists of the Customer receiving a Product selected by the Seller for €1 after entering the Discount Code indicated in the Promotion Information.
6.2.2. The €1 Product is automatically added to the Cart after the Customer correctly enters the Discount Code. If the Product is unavailable, the Seller may not apply this part of the Promotion or may replace it with another Product — only if the Promotion Information provides for this.
7. Returns and withdrawal from the contract in Promotions (including “€1”)
7.1. The Customer has the right to withdraw from the contract under the terms resulting from applicable laws and the Store Terms and Conditions.
7.2. Return rules for bundle promotions and discounts
7.2.1. If the discount depended on meeting a condition (e.g., number of Products, a minimum order value threshold), and the return causes the condition to no longer be met, the Seller has the right to adjust the discount value accordingly (and thus the refund amount) as if the Promotion conditions had not been met — provided that this results from the discount mechanism and is reflected in the settlement.
7.3. Return rules for the “Product for €1”
7.3.1. A Product purchased for €1 under a Promotion does not entitle the Customer to request a refund of its value at the regular price or any monetary equivalent.
7.3.2. In the event of returning part of the order, if after the return the Customer no longer meets the condition for obtaining the Product for €1 (e.g., falls below the threshold), the Customer is obliged to:
a) also return the €1 Product, or
b) if they do not return it — the Seller may reduce the refund amount by the regular price of that Product (or another value indicated in the Cart/at the settlement stage, if applicable).
7.3.3. In the event of returning the entire order in which the Customer received a Product for €1 (both in Mechanism A and B), the Customer is obliged to also return the €1 Product. If the €1 Product is not returned, the Seller may reduce the refund amount by the regular price of that Product.
8. Limits and wholesale purchases
8.1. The Seller may apply limits to Promotions (e.g., quantity, time, per Customer) — these will be communicated in the Promotion Information or in the Cart.
8.2. Promotions are not intended for wholesale purchases. In the event of a justified suspicion of abuse, the Seller may refuse to apply the Promotion or to fulfill the order on promotional terms.
9. Complaints related to Promotions
9.1. The Customer may submit complaints regarding the calculation/application of a Promotion electronically or in writing to the Seller’s contact details provided in the Store.
9.2. Complaints are processed within 14 days of receipt.
10. Personal data
10.1. The rules for processing personal data are set out in the Privacy Policy available in the Store.
11. Final provisions
11.1. These Terms and Conditions apply from the date of publication in the Store.
11.2. Matters not regulated herein are governed by the Store Terms and Conditions and the provisions of Polish law.
